Take a look at Bt.com for a great example of tackling the new requirements in a non-intrusive way - click on the "change settings" link for a neat slider to help customers manage their cookie settings.

I would also recommend reading the Econsultancy blog from Glynn Davies and the comment thread - some interesting view points and evidence that there is no concensus of how to tackle this but you can't ignore it without risking repercussions.
